Illegal Disposal of Trash or Solid Waste
There are strict City-Parish ordinances in place governing the proper disposal of garbage, trash and other forms of solid waste. Any accumulation, collection or handling of this type of garbage or trash – such as items you would normally put in your garbage can and instead place it in the public right-of-way or into a stream – is considered a nuisance and may involve prosecution for such violations. For more information, please see Sec. 6:387 of the Baton Rouge Code of Ordinances.
In addition, Secs. 2:362-372 of the Code of Ordinances govern compliance with stormwater standards and general discharge prohibitions. Given the costs associated with the City-Parish contracting with firms to appropriately dispose of harmful substances such as petroleum or antifreeze, the penalties associated with unlawful disposition are extreme – such as civil enforcement penalties of up to $1,000 per day, per violation – and actively enforced by the City-Parish. If you are aware of illegal disposal of trash or solid waste that has taken place, please contact 3-1-1 with as many details as possible regarding the incident.
